These Terms of Use ("Terms") govern your access to and use of SnapGap (the "Service"), operated by deKoning Technologies Limited, Company Registration Number: 795796 ("Company", "we", "us", or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms then you do not have permission to access the Service.

1. Account Registration and Security

You must provide accurate, complete, and current information when creating an account.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.
Important: SnapGap will NEVER ask you for your official RSA portal login credentials. Our software is designed to operate independently and fully compliantly without requiring direct access to your RSA account.

2. Acceptable Use

You agree not to use the Service:

In any way that violates any applicable national or international law or regulation, including RSA guidelines.
For the purpose of exploiting, harming, or attempting to exploit or harm minors or any other individuals in any way by exposing them to inappropriate content or otherwise.
To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail", "chain letter," "spam," or any other similar solicitation.
To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity.

3. User Data and Compliance

You retain all rights to the data you upload to the Service, including student information and lesson records. You are solely responsible for ensuring that you have the necessary consents to process and store your students' data on our platform.

While we provide tools to help you manage your EDT records and export them in RSA-compliant formats, you remain ultimately responsible for verifying the accuracy of all data submitted to the official RSA portal.

4. Intellectual Property

The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of deKoning Technologies Limited and its licensors.

5. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

6. Limitation of Liability

In no event shall deKoning Technologies Limited, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of Ireland, without regard to its conflict of law provisions.
